8.1 Service Availability
Our Services are provided "as is" and "as available." Subject to applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure, though we strive to maintain high standards of service availability and reliability.
Note: Some jurisdictions do not allow the exclusion of certain warranties. In such cases, the above exclusions may not apply to you, and you may have additional rights under applicable consumer protection laws.
8.2 Limitation of Liability
To the maximum extent permitted by applicable law, CorePT and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to use the Services
- Any conduct or content of any third party on the Services
- Any content obtained from the Services
- Unauthorized access, use, or alteration of your transmissions or content
Our total liability for all claims arising from or relating to the Services shall not exceed the greater of (a) the amount paid by you for accessing our Services during the twelve (12) months immediately preceding the claim, or (b) one hundred pounds (£100).
Note: Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
8.3 Trainer-Client Relationships
CorePT facilitates connections between trainers and clients but is not a party to any agreement between them. Trainers are independent professionals, not employees or agents of CorePT. We do not employ, recommend, endorse, or verify the qualifications of trainers.
We are not responsible for:
- The quality, safety, or appropriateness of training programs created by trainers
- Disputes between trainers and clients
- Injuries, damages, or losses arising from trainer-client relationships or training activities
- Trainers' compliance with professional standards, certifications, or legal requirements
- Payment disputes or arrangements between trainers and clients made outside the platform
Trainers and clients are encouraged to establish their own terms of engagement, including liability waivers and service agreements, independent of CorePT.
8.4 Indemnification
You agree to defend, indemnify, and hold harmless CorePT and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Services, violation of these Terms, or violation of any third-party rights.
